AGREEMENT

The following Terms and Conditions of Use fully apply to this website. These terms of use constitute a legal agreement between you and Latin Focus ("Latin Focus", "We" or "Our"). Please read this agreement ("Agreement") in its entirety before you continue to use this website ("Site"). By using this website you agree to be bound by the terms of this agreement. Ownership

All images on this site are copyrighted by Latin Focus and the photographers who created the images. This website is owned and operated by Latin Focus. All of the content featured or displayed on this website, including, but not limited to, text, graphics, photographs, images, moving images, sound, illustrations and software ("Content"), is owned by Latin Focus, its licensors and its content providers. Images of people or places displayed on the Site are either the property of, or used with permission by Latin Focus. The use of these images by you, or anyone else authorized by you, is prohibited unless expressly authorized by Latin Focus or this Agreement. This Site, its Content and all related rights shall remain the exclusive property of Latin Focus unless otherwise expressly agreed.

INTELLECTUAL PROPERTY RIGHTS

All elements of the Latin Focus website, including, but not limited to, the general design and the Content, are protected by trade dress, copyright, moral rights, trademark and other laws relating to intellectual property rights. No images may be used for other websites without prior written permission from Latin Focus and a negotiated license fee paid. Images may not be LINKED from your site to ours or published in any way, medium or media without written permission and appropriate fees paid to Latin Focus for each use. No portion or element of this Site or its Content may be copied or retransmitted via any means or in any media digital or non-digital in a manner that violates applicable intellectual property law. You may not post any image or images from this Site on any electronic bulletin board, put the images on-line in a downloadable format, or use the ! images in a website. The fee and/or prosecution described in the following paragraph shall apply to each and every unauthorized use of an individual photographic image per use on the web or other form of media.

Use of any image or derivative of any image as the basis for another photographic concept or illustration is a violation of International Copyright Law. Latin Focus and its represented photographers/artists/designers protects copyright interests. In the event that an infringement is discovered you will be notified and invoiced the industry standard triple fee for unauthorized usage and/or prosecuted for Copyright Infringement in International Court where violations are punishable by a fine of up to US $150,000 statutory damages in addition to all court costs and attorneys' fees.

WATERMARK REMOVAL

Watermarking involves digitally embedding into an image a symbol that identifies the copyright holder. The Digital Millennium Copyright Act of 1998 makes it a criminal offense to remove watermarks meant to protect copyright. Under US copyright law, it is specifically illegal to remove a watermark from a photo. Not only is the act of removal prohibited, the courts assume that the very attempt indicates a willful intent to violate copyright protection.

TRADEMARK

"Latin Focus" is a registered trademark owned by Latin Focus. Nothing contained on the Site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use of the Latin Focus trademark without the written permission of its owner. Your use of the name "Latin Focus" which is our registered Trademark, or any other content on the Site, except as provided in these Terms of Use, is strictly prohibited.

COMPING

You may download images to comp for temporary layout purposes in order to make way for future licensing of the image through Latin Focus. There must be an actual intent to purchase the picture and temporary use must be in the composition of a book or other product pending the issuance of a license from Latin Focus.

GOVERNING LAW; VENUE

These Terms and Conditions shall be interpreted, construed and governed by the laws in force in the state of California, without reference to its conflict of laws principles. Any action, proceeding, dispute, claim or controversy arising out of or relating to this Site or these Terms and Conditions, or any Latin Focus product or services offered on or accessed via the Site, shall (i) be governed by California State law and controlling U.S. federal law, without application of any choice of law rules and (ii) be subject to the exclusive jurisdiction of the courts of the State of California or of the United States District Court of the Southern District of California, and you hereby submit to the jurisdiction of said courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms and Conditions.

BREACH OF AGREEMENT

Entering this web site implies that you agree to be bound by the above terms. Entrance to the web site is expressly on these conditions, which embodies all of the understandings and obligations between the parties hereto.

You shall indemnify Latin Focus, its subsidiaries, its affiliates, third party content providers and licensors against any losses, expenses, costs or damages incurred by any or all of them as a result of your breach of the terms of this Agreement or your unauthorized use of the Content and related rights. Under these right of indemnidity we shall include the industry standard thriple fee per violation.
